1. Agreement to Terms

By installing or using ProductPoll ("the App", "we", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.

2. Description of Service

ProductPoll is a Shopify application that enables merchants to:

• Create polls with two product image options
• Display polls on their Shopify storefront
• Collect votes from store visitors
• View poll results and analytics

3. Eligibility

To use this App, you must:

• Have an active Shopify store
• Be at least 18 years old
• Have the authority to bind your business to these Terms
• Comply with all applicable laws and Shopify's Terms of Service

4. Account and Access

4.1 Installation

You install the App through the Shopify App Store. Installation requires OAuth authentication to access your store data.

4.2 Required Permissions

The App requests the following Shopify permissions:

• Read products: To help you select products for polls
• Write script tags: To display the poll widget on your store

4.3 Your Responsibilities

• Keep your Shopify account secure
• Maintain a valid and active Shopify subscription
• Ensure poll content complies with laws and Shopify policies
• Notify us immediately of any security breaches

5. Acceptable Use

5.1 You May:

• Create polls for legitimate business purposes
• Display polls to gather customer preferences
• Use poll data to inform business decisions

5.2 You May NOT:

• Use the App for illegal purposes
• Create polls with offensive, harmful, or illegal content
• Attempt to manipulate vote results
• Reverse engineer or copy the App
• Use the App to collect personal data beyond what's necessary
• Violate any applicable laws or regulations
• Interfere with the App's operation or security
• Use the App to spam or harass users

6. Pricing and Payment

6.1 Current Pricing

ProductPoll is currently free to use.

6.2 Billing

• Charges (if any) are processed through Shopify's billing system
• All fees are in USD unless otherwise stated
• Taxes may apply based on your location

6.3 Refunds

As the app is currently free, no refunds are applicable. If paid features are introduced, refund policies will be updated accordingly.

7. Data and Privacy

7.1 Your Data

• You own all poll data you create
• We store data securely in compliance with our Privacy Policy
• You can export your data at any time
• Data is deleted when you uninstall the App

7.2 Customer Data

• You are responsible for complying with privacy laws regarding your customers
• We collect minimal customer data (IP addresses for vote tracking)
• You must have appropriate privacy policies on your store

8. Intellectual Property

8.1 Our Rights

ProductPoll, including all code, design, and features, is our intellectual property. These Terms do not grant you any ownership rights.

8.2 Your Rights

You retain all rights to:

• Poll questions you create
• Product images (subject to their original licenses)
• Your business data and customer insights

8.3 License

We grant you a limited, non-exclusive, non-transferable license to use the App while you maintain an active subscription.

9. Service Availability

9.1 Uptime

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.

9.2 Changes to Service

We may:

• Add new features (usually free)
• Modify existing features
• Discontinue features with notice

9.3 Support

Support is provided via:

• Response Time: Within 48 hours (business days)

10. Limitations of Liability

10.1 Disclaimer of Warranties

We do not warrant that:

• The App will be error-free or uninterrupted
• Defects will be corrected immediately
• The App will meet your specific requirements
• Vote results will be 100% accurate (spam votes may occur)

11. Indemnification

You agree to indemnify and hold harmless ProductPoll and its developers from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you create in polls

12. Termination

12.1 By You

You may terminate at any time by uninstalling the App from your Shopify admin. All your data will be deleted automatically.

12.2 By Us

We may terminate your access if:

• You violate these Terms
• You engage in fraudulent activity
• Your Shopify store is closed
• Required by law

12.3 Effect of Termination

Upon termination:

• Your access to the App ends immediately
• Billing stops (no refunds for partial periods)
• Your data is deleted within 48 hours
• The poll widget is removed from your store

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by:

• Email notification (if available)
• Notice in the App
• Updating the "Last Updated" date

Continued use after changes means you accept the new Terms.

14. Governing Law

These Terms are governed by applicable law, without regard to conflict of law principles.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any claim, contact us at productpollapp@gmail.com to resolve the issue informally.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

17. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and ProductPoll.
